Senate Passes Defense Bill with “1033 Program” Language

The Senate passed the compromise version of the Fiscal Year 2021 National Defense Authorization Act Friday, December 11, 2020, in an 84-13 vote, following a 335-78 earlier in the week in the House of Representatives.

The bill authorizes military spending for this fiscal year 2021. This year’s bill also includes provisions that would place certain restrictions on transfers of surplus military gear to civilian law enforcement, known as the “1033 Program.”

It would restrict the transfer of bayonets, grenades, weaponized track combat vehicles, and weaponized drones. It would also require law enforcement agencies that receive 1033 equipment to certify that their police officers receive annual training on “respect for the rights of citizens under the Constitution and de-escalation of force” (Office of Senator Schatz).
