POAM Executive Board Meeting Minutes for October 2009

1.    The October 1, 2009, Executive Board Meeting was called to order by President James Tignanelli. The meeting was held at the Great Wolf Lodge in Traverse City, Michigan during the Fall Seminar.

      Present: Tignanelli, Kuhn, Funke, DeVries, Spidell, Pushee, Beerbower, Loftis, Scherer, Zacks, Lewis, Atkinson, Allgeier, LaMontaine, and Postal.

      Excused: Birdseye, Radovic, Grabowski, Valentine and Hochstein.

2.    President’s Report

The meeting was called to order by President James Tignanelli. The Fall Seminar included a presentation by LifeLock, Cadillac Insurance and legal updates by the POAM legal staff.

President Tignanelli introduces Wayne Ivey of LifeLock. Wayne stated identity theft has increased drastically over the years. The presentation showed how LifeLock and their services could help law enforcement personnel protect themselves and their families. A special offer was offered to all POAM members. President Tignanelli introduces John O’Connor and Brian Cote of Cadillac Insurance. They are third party administrators and believe they can save municipalities on insurance costs. Contact Cadillac Insurance at 1-888-775-1293 prior to contract negotiations for assistance and information. Cadillac Insurance will deal directly with the municipalities and the unions in person during the negotiation process. (Brochure on file).

The legal updates were provided and presented by General Counsel Frank A. Guido, and Assistant General Counsel George Mertz. Frank Guido provided information regarding the following political issues:

·House Bill 6112 (Correction Officer Compulsory Arbitration Act Streamlined).

 

·Changes in House Bill 5325 introduced by Rep. Haverman (R). POAM opposes this bill. The changes will affect compulsory arbitration and labor disputes in municipal police and fire departments.

 

·House Bill 5287 (Michigan Motor Vehicle Code) Ticket quotas will no longer be allowed nor can administrators make reference to lack of productivity (citations issued) in performance evaluations.

 

·New case law. The Wayne County Sheriff’s Department deputies have brought about changes in the law regarding the Public Employment Relations Act. Now members can changes unions without giving up the rights to retroactivity.

 

·Compulsory Arbitration. Unilateral changes, wages, hours, benefits, and employment conditions. Sec 13 is status quo under the new law; unions must now show irreparable harm to their membership

 

3.    Secretary’s Report

Motion by Gary Pushee, seconded by Mark Zacks to accept the minutes of the September 11, 2009 Executive Board meeting. Motion carried.

4.    Treasurer’s Report

No report.

5.    Motion to Adjourn.

      Next Executive Board meeting to be held November 6, 2009 at the POAM Office in Redford, MI.
